What Does Alabama’s Pure Contributory Negligence Law Mean For Your Personal Injury Claim?

Alabama is one of four remaining states that still have a “pure contributory negligence” law in effect, while the other 46 states practice different forms of “comparative negligence.”

Under comparative negligence doctrines, you can recover compensation in a personal injury claim, even if you are partially at fault. However, your recovery of damages may be reduced by the percentage of fault assigned to you (“pure” comparative negligence). In most states, if the assigned fault exceeds 50%, you would be barred from recovering damages (“modified” comparative negligence).

By contrast, Alabama’s pure contributory negligence doctrine asserts that if a plaintiff is proven to have any measure of fault in a claim, even as little as 1%, it can bar them from receiving any damages. The burden in such cases is on the defendant to prove that the plaintiff's conduct contributed to the fault that caused injury.

The doctrine of pure contributory negligence would not apply if a defendant's conduct were found to be "wanton, willful,or intentional." The other exception to the law relates to children, those with diminished mental capacity, or those who are adjudicated incompetent.
